With over 20 years experience Wax Digital’s eSourcing Director, Paul Layzell will be taking a detailed look at some of the lessons learned from managing and conducting electronic auctions and tenders in the public sector - by looking closely at what to do and what not to do we’ll be highlighting how to avoid the risks and maximise results throughout the eSourcing process.

The remedies directive : understanding the implications
Buying under the public procurement legislation has always been complex and associated with risk; a risk which has increased with the recession, sharpening suppliers’ interest in challenging purchasers in the public sector. This is reflected in a considerable increase in requests for debriefing, linked to a large increase in the number of decided cases in the UK courts.
The risks of getting procurement wrong have also increased with the introduction of the new remedies directive which came into effect in December 2009 and which brings with it the risk of considerable financial loss and operational problems arising from the termination of contracts.
This session will:
- Examine trends in UK court cases challenging procurement decisions
- Set out the key changes to legal challenge mechanisms brought in by the 2009 amending regulations
We’ll also be examining the implications of:
- Changes to the standstill period
- The increased requirements for supplier debriefing
- The automatic suspension of contract award procedures
- The ineffectiveness provisions (leading to termination of contracts, civil penalties and/or contract shortening)
- Assess the real risk of supplier challenge in the light of these developments
Q&A sessions will follow both seminars
